2. What does the Supreme Court do without a 9th justice?
-they function normally like they have in the past
-a 4-4 tie means they can not issue a national ruling so they are a little choosey when it comes to cases that they would want a 5-4 win on

3. What is the potential problem with having only 8 justices?
-cases that have a 4-4 tie means that the SC can not issue a nationwide ruling so they have to be choosey to get cases that they can effectively rule on

4. How many cases are already scheduled to be heard by the Court?
-six cases next week
-five cases the week after
-six cases the last week of October
-six cases the first week of November
-23 CASES TOTAL

5. If Judge Kavanaugh does join the Court, what happens to the cases that he has not heard?
-he could rule on them but there is a precedent for him to recuse himself from their rulings
-there are not many that he would have strong opinions about coming up

6. What is the upcoming Supreme Court case about that deals with the 8th amendment?
-they must determine if the 8th Am. protects people who can no longer remember their crimes (due to strokes) from the capital punishment


7. What is the result if the Supreme Court decision is a 4-4 tie?
-lower courts' rulings stay in effect which is tricky if the lower courts contradict each other
